Terms of service

1.1  The management (hereinafter “management of website” or “management”) of RENTAL.AGENCY website (hereinafter “the website”) provides its service to user (hereinafter “you” or “user” or “renter”) to advertise and promote all types of rentals through Software as a Service (hereinafter “SaaS”) on a subsite subject to the following Terms of Service (hereinafter “TOS”). Please read them carefully before using the website. By accessing and using the website, you declare that you have read and agreed to these Terms of Service. If you do not accept the TOS, you may not access the website or use the information contained on the website.

The management reserves the right to amend these TOS, from time to time, with or without any notice. By continuing to use the website after the management posts such amended TOS, you accept them, as amended. It is your responsibility to visit this page regularly to check and read the amended TOS.
The original version of this TOS is written in English language. If there is any contradiction between what the original version means and what any translation means, then the original version shall take precedence.

The website is hosted using the facilities within the United States of America. You may not use the website in violation of any laws and regulations of United States of America or Sri Lanka. Additionally, you are responsible for compliance with all local laws and regulations applicable at the place you access the website from, where such location is outside Sri Lanka and in the country where it is hosted.

You are responsible for obtaining service access and all equipment necessary for service access.

2  Description of service

2.1  The management currently provides a SaaS to Trial Users and Paid Registered Users to advertise and promote all types of rentals on a subsite of the domain RENTAL.AGENCY approved by the management subject to the terms and conditions for Registered Users.

2.2  The management provides an online content management control panel which is developed, maintained and hosted by the management in order to access the service as described in clause 2.1.

3   Trial User of SaaS based advertising service

3.1  Only those who are eligible to enter into legally binding contracts under the applicable law can become a Trial User.

3.2  To become a Trial User, the prospective renter must first accept our Terms and Conditions and submit the online application form.

3.3  A Trial user will be given a password and will be permitted to access a subsite to carry out testing of our SaaS advertising platform.

3.4  A Trial subsite will be valid for a period of one calendar week unless deleted by the management.

3.5  A Trial user is NOT bound to become a Paid Registered User during or after the Trial period.

3.6  The management is NOT bound to provide paid registration to use our SaaS on a subsite for any Trial User during or after the Trial period.

4   Paid Registered User of SaaS based advertising service

4.1  Only those who are eligible to enter into legally binding contracts under the applicable law can become a Paid Registered User.

4.2  To become a Paid User, the prospective renter must first accept our Terms and Conditions and submit the online application form.

4.3  If the application is accepted and approved by the management, an invoice will be sent from our billing department to the prospective Paid Registered User.

4.4  Upon completion of the payment, an account will be created for the Paid Registered User and will be given a password to advertise and promote all types of rentals on the subsite under the requested name.

4.5  The Paid Registered User account will be valid only during the period for which the payment has been made unless renewed, on or before the due date, by the Paid Registered User.

4.6  Expired Paid Registered User accounts will be deleted, within 7 business days, together with the advertising content submitted to the subsite.

5  Interruption, Suspension and Termination of Service

5.1  The management reserves the right to interrupt the Service (the service intended for visitors to this website, Trial User and Registered User) for planned maintenance or unplanned and unannounced maintenance of the website or any other service related to the website.

5.2  The management reserves the right at any time to refuse the service(s) to any user, Trial User or Paid Registered User, found to be in breach of these TOS.

5.3  The management also reserves the right at any time to suspend and/or terminate the services to any Trial User or Paid Registered User if found to be in breach of agreement in accordance with the TOS in the case of an Trial User or in accordance with both TOS and “Terms and Conditions for Paid Registered Users” in the case of a Paid Registered User.

6  Privacy & Cookie Policy

6.1  The use of the service of the website is subject to the privacy policy described at www.rental.agency/privacy.

7  Acceptable Use Policy

7.1  The use of the service of the website is subject to the Acceptable Use Policy described at www.rental.agency/aup.

8  DMCA and Abuse Policy

8.1  The use of the service of the website is subject to the Digital Millennium Copyright Act and Abuse Policy described at www.rental.agency/dcma-abuse-policy.

9  Refund Policy

9.1  The use of the service of the website is subject to the Refund Policy described at www.rental.agency/refund-policy.

10  Indemnity

10.1  You understand and agree to indemnify and hold the owner of the website, management, company directors and shareholders of the management, affiliate or affiliates of the management, partner or partners of the management, administrator or administrators appointed by the management, operator or operators appointed by the management, management staff of the management, and publishers of the management, harmless from any claim or demand, including attorneys’ fees (lawyers’ fees) and court costs, made by any third party due to or arising out of Content you submit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, your violation of “Terms and conditions for Paid Registered Users” in the case of a Paid Registered User or your violation of any rights of another.

11  Disclaimer

11.1  You Understand and agree that the use of the website is at your own risk. All content available through the website is provided on an “AS IS” AND “AS AVAILABLE” basis. Neither the website owner, nor management nor operator, nor any partner, nor any related company, nor any of the employees, nor any agent, nor any content provider to subdomains, nor any advertiser, makes any representation or warranty of any kind regarding the website, the content, any advertising material, or the results that may be obtained from use of such advertising services or sites. The management makes no warranty that the website will meet your requirements, be uninterrupted, timely, secure or error free or that website or the server that makes it available are free of viruses or other harmful components or destructive files.

12  Limitation of liability

12.1  Under no event shall the website owner, management, operator, employees, agents, content providers to sub domains or advertisers be liable for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever arising under or as a result of these TOS, the use or inability to use this website or the contents of this website, whether based on warranty, contract, tort, or any other legal theory, and whether or not the website management is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
